While he may claim he is confident, his persona comes across rather arrogant. While working with him I felt comfortable but the moment I heard him talk to someone else I was embarrassed to have him speak. Rather than work through issues, everything got escalated and required a fight which was expensive and wasn't really what we wanted.
Surprisingly, as a certified mediator, Dan believes that both parties have to agree to 100% of the issues or 0% of the issues. He refuses to get at least the common ground agreed to. Despite lengthy sessions all parties agreed were going no where, Dan had no problem continuing not one but two unproductive sessions and then billing $200+/hour for getting nothing agreed to. Guess what, that was why we were getting divorced and Dan did nothing to get to common ground (but he did make $$$).
Horrible experience. Expensive, rude, condescending, hateful, yells a lot, never has time to do things. I wanted to hire Jackie Davis, but was told I had to hire him to get her, but then he took over control. He charged $8000 and the case never even got halfway. He lies and blames you for his oversights and shortcomings, and that got me in trouble with the Family Court, so I fired him. Never got a penny refunded. I deal with the general public every day in my business, but I'd rate Mr D'Agostino as one of the top three worst people I've ever had the misfortune to run across. He even implied a threat against me during one of his temper tirades. Awful awful man. RUN AWAY, RUN AWAY!

The Client Review Rating score is determined through the aggregation of validated responses. Martindale-Hubbell validates that a reviewer is a person with a valid email address. As part of the review process, respondents must affirm that they have had an initial consultation, are currently a client or have been a client of the lawyer or law firm identified, although Martindale-Hubbell cannot confirm the lawyer/client relationship as it is often confidential. The content of the responses is entirely from reviewers.

Martindale-Hubbell® Peer Review Ratings™ are the gold standard in attorney ratings, and have been for more than a century. These ratings indicate attorneys who are widely respected by their peers for their ethical standards and legal expertise in a specific area of practice.
The Martindale-Hubbell Peer Review Ratings process is the gold standard due to its objectivity and comprehensiveness. Lawyers solicited for peer reviews include both those selected by the attorney being reviewed and lawyers independently selected by Martindale-Hubbell. All reviewers are verified as attorneys through Martindale-Hubbell’s extensive attorney database. Only attorneys practicing at least three years and receiving a sufficient number of reviews from non-affiliated attorneys are eligible to receive a Rating.
What are the different Martindale-Hubbell Peer Review Ratings?*
• AV Preeminent®: The highest peer rating standard. This rating signifies that a large number of the lawyer’s peers rank him or her at the highest level of professional excellence for their legal knowledge, communication skills and ethical standards.
