Yes, you probably do have a claim against the owners of the apartment building. Hopefully, you put your complaint in writing when you made it to the manager, who could likely say she never received your complaint so she does not get in trouble for not reporting to the owners. However, you cannot use evidence of the improvements against the owners to prove that the stairs were faulty in the first place. You can use the photos of the stairs as they were on the date that you fell. But to show that the stairs were actually fixed later to prove that the owners knew that the stairs were hazardous is against public policy in California. Such evidence would dissuade owners from making the necessary improvements on their property to make it safe, if they knew the improvements could be used against them. However, again, taking the photos of the stairs as they were when you fell should be sufficient to show that the stairs were hazardous, thus making the owners liable. Remember THAT is why owners have property insurance, to cover liability for injuries that occur on their properties.
