Does anyone have to comply with probation terms before actually being sentenced and placed on probation?

Hudson Thomas Bair
Answered by attorney Hudson Thomas Bair (Unclaimed Profile)
DUI/DWI lawyer at Kapsack & Bair, LLP
Maybe, many jurisdictions have pretrial release conditions that are just like probation, some require reporting to probation officers, chemical testing and other more draconian tactics that make your life miserable. An experienced DUI defense attorney in your area can provide you with more localized information and other advice that may help you avoid a DUI conviction.

Can my case be thrown out of court due to lack of evidence if given a DUI citation that you took a breath test but ticket says a blood test?

The breath/blood results are the only thing that matter. The wrong box being checked will not result in a dismissal.

What are my chances that I can get this DUI set aside in court?

Without any blood or breath test, the prosecutor can still proceed, but they will have a much more difficult task than if they had scientific proof. Now, all they have is the opinion of the officer. I have won cases like that, but you are not guaranteed to win. Every case is different. In this case, important factors will be the apparent credibility of you, and the apparent credibility of the officer, in the eyes of the jury. The goal is to get a not guilty verdict from the jury. Once you are convicted, it normally will be very difficult to get that conviction overturned.
