Not necessarily. Depending upon the source of the funds used to purchase the home and the rest of the settlement a) it would be equity at issue, not the value of the home; b) it may not be 50%, and c) he does not have to buy you out - the court could require that the home be sold.

Your husband always has the option of firing his lawyer and finding a new one. If he agrees on your terms, your lawyer could draft a settlement and he could find a new lawyer to review it. Otherwise, it sounds like your lawyer needs to pursue ways of penalizing him/his lawyer with the court. Good luck!
