Honestly, there is no good defense. If you haven't been making your payments, you haven't been making your payments and the lender has the right to have the stay lifted. There are some strategies though. First, if you are trying to get a modification and you have submitted the application and it is under review, then you don't need the stay in your bankruptcy. Let them lift it. The other is to go to court and request that the Judge let you make adequate protection payments of an affordable amount, until your discharge date, when the stay will be lifted by operation of law. Other than that, you really don't have a good defense based on your posting.

Unless there is something officially writing restricting your title at the time it was transferred to you then you own the RV free and clear. Depending on its value you may be able to keep it or it will be taken by the trustee and sold to pay your creditors. You have a certain amount of exemptions to protect the RV and other property/assets. That amount is to protect your vehicles and other property including bank accounts and the cash in your pocket if any. You need to check with a lawyer as to how much your exemptions are, what they are for and how you can use them to your best advantage.

As I understand it, you are not filing bankruptcy, your partner is. I hope I understood that correctly. She has included all of her credit card debt in the bankruptcy (as she is legally obligated to do). You want to know if you will be liable on the debt. The answer to this question depends on who was liable on the debt before the bankruptcy. Whether you used the card or not is not really an issue. The issue has to do with whether you signed an agreement with the credit card company to be liable on all of the debt. If your partner merely authorized you to use a card on her account you are not liable for the debt. The bankruptcy would have nothing to do with your liability. If, however, you did sign an agreement with the credit card company to assume liability on the debt (this is not the same as signing to approve a single transaction at a retail store), then you are still liable for the entire debt on any card that you signed on regardless of your partner's bankruptcy.
