Yes, you are being sued. This happens all the time. Technically, you were not being sued before, the other party tried to negotiate with your insurance company, who refused the claim. Now, the other party (called the "Plaintiff") has a lawyer who has named you as a defendant. They think the accident was (at least partially) your fault and that the Plaintiff was indeed seriously injured. Whose right? Who knows? That's why we have lawsuits. So here's what you do: make several copies of the "Summons and Complaint" (these are the papers you were served). Send copies to the insurance company. It is vitally important that you do this immediately, don't wait another day. Get a copy to your insurance agent and make him sign for it. Find out where the claims office is for the insurance company and send them a copy by certified mail. If they tell you it's not necessary, do it anyway. The insurance company will hire a lawyer to defend you and if you are assessed liability, they will pay it. You must co-operate in all respects, which means show up for depositions, meet with the lawyer when asked to do so, etc. Good luck.
