Persona injury case setteled out of court. Ins co. had the documents since 4-25-14 and still no check. Is there a time limit in NJ?

Answered by attorney Diana L. Anderson
Personal Injury lawyer at Diana L. Anderson
Its really not been that long of a time, although it must seem like it !  Many attorneys deal with dozens of cases at one time, and have many, many documents to handle.  Your releases were probably sent to the insurance company, who will take their time in paying your claim, and then it will come to the attorney.  If you are concerned, call the attorney, ask to speak to the paralegal and ask if there is an anticipated date on which you will receive payment.

Is civil law the specific type of case or area of law?

Spencer Edward Farris
Answered by attorney Spencer Edward Farris (Unclaimed Profile)
Personal Injury lawyer at The S.E. Farris Law Firm
Civil law is a generic term that refers to anything but criminal matters. Family law, patent law, and just about everything else you can think of that is not a criminal matter falls under that heading.

If a student is injured at school, is the school responsible for paying medical cost incurred from injury, when another student was involved.

Answered by attorney Diana L. Anderson
Personal Injury lawyer at Diana L. Anderson
I would need more information regarding how the injury occurred but it seems to me that the school and/or the child that poked your son is responsible for the medical bills, as well as the pain and suffering, but this is probably going to require litigation to get them to accept responsibility.  Has this other student ever assaulted anyone else?  Is there a history of this type of behavior?  Was the school negligent in supervising this student and/or correcting his/her behavior?  How old is the other student?  The students parents may be responsible for his/her behavior.   This is definitely something you should discuss with a lawyer because your son should be entitled to compensation for paid and suffering, not just reimbursement of medical expenses.
