Am I liable for damages caused by an act of nature?

Travis S Prestwich
Answered by attorney Travis S Prestwich (Unclaimed Profile)
Personal Injury lawyer at Swanson Lathen Prestwich, PC
If a truly is an act of nature, you probably are not liable. However, if there are things you could have or should have done to secure the canopy, then you could be held liable. Your insurance company for your homeowner's policy can make a determination.

Is there anything that can be done about being scammed by an online classified advertisement?

Anthony O. Van Johnson
Answered by attorney Anthony O. Van Johnson (Unclaimed Profile)
Personal Injury lawyer at Anthony Overton Van Johnson Associates, P.C.
I am assuming that your friend purchased the car without any warranty. When it comes to purchasing a used car, it's pretty much "buyer beware", as the Buyer (without a warranty) is purchasing the vehicle "AS IS". The exception would be where the Seller, in some way, intentionally misleads the Buyer about the condition of the vehicle or engages in some form of fraudulant activity. Also, where the Seller is unable to produce a clear title to the vehicle, this would be a cause of action. Whenever purchasing a used vehicle, the Buyer should always (1) take the vehicle to a mechanic of his or her choosing to have a "pre-purchase inspection" performed; and (2) it is also advisable to obtain a CarFax report to check for any reported vehicle damage.

If my daughter has an at fault accident in my auto can I get sued?

Answered by attorney Theodore A. Speaker (Unclaimed Profile)
Personal Injury lawyer at Speaker Law Firm
Yes, it is your vehicle and you are responsible for the driver. You always sue the person who hit you, not the insurance company. The insurance company was not driving the car.
