To answer the question properly, one would need extensive examination of all the evidence, particularly the medical records. If you have a lawyer, then working out a negotiating strategy and bottom-line recommendation is his/her job. If you don't I urgently advise you to get one right away. Do not try to settle this on your own. There are many rules, procedures, exceptions, requirements etc. and it is very easy to get tripped up. Seriously, this is a tricky business and there is no room for do-it-yourselfers. You would be up against professional insurance people, lawyers who know what they're doing and rules upon rules upon rules that you don't know anything about. If you retain a lawyer you will be much more likely to get the right result, particularly considering the level of damages you have described.

I don't have enough information to tell whether your have a worker's comp or a personal injury matter. My general advice on lawyers is first and foremost schedule and appointment and sit down with him or her face to face. Write your questions down before your meeting so you don't forget them. Don't be afraid to ask "why" and for him or her to explain the law to you. Sometimes it won't make sense but I have found when a lawyer takes his or her time and explains the details, it tends to help the client a great deal.

The medical records are hers. The bigger problem is finding them. Chances are they are locked away somewhere or possibly even destroyed. She just needs to go to the facilities that have them and ask for them.
