My husband and I received a subpoena but we can't afford to go. What should we do?

Generally a Subpoena has a jurisdictional. Generally you may not be compelled to attend a hearing outside of the county in which you reside, and certainly not outside of the state in which you reside. You may need a lawyer to research your exact question depending on your exact circumstances. If you are a party to the litigation, there can be other repercussions for not attending even if the Subpoena is technically invalid. There also could be other extenuating circumstances that apply, which is why it's always smart to have a lawyer provide you a legal analysis of your specific fact situation.

Can I sue the school or the school board for my son's broken and swollen foot?

James Peirce Kelaher
Answered by attorney James Peirce Kelaher (Unclaimed Profile)

You can sue the school board for negligence, but you're going to have a heck of a time proving what difference getting him to the doctor 6 hours earlier would have made. Before you consider bringing a claim, you might want to ask the doctor the next time you bring your son to the doctor whether seeing your son 6 hours made any difference. I know you're upset because they didn't notify you right away, but you need to prove what, if any, difference would have been made had he seen your son 6 hours earlier.

My daughter was injured at school can I sue the school?

James Peirce Kelaher
Answered by attorney James Peirce Kelaher (Unclaimed Profile)

You can only sue the school (successfully) if you can prove the school was negligent. Just because some other student threw a rock at your daughter doesn't mean some teacher was not doing her job. Why don't you make the claim against the homeowner's insurance of the kid who threw the rock?
