Assuming your question is not relating to a criminal prosecution, but a claim for property damage or personal injuries made by you or against you, those records can be obtained by way of subpoena after the filing of a lawsuit. I am also assuming that your cell phone use at time of the accident is a relevant issue the other motorist or their carrier may use to argue that you either caused or contributed to the accident, because you were on your cell phone at the time of the accident. Also, regarding the absence of bodily injury your cell phone use may be a relevant inquiry again for purposes of a property damage claim by other motorist or their carrier. However, each instance, unless you authorize release of the phone records, will require the filing of a lawsuit or small claims action such that the party attempting to obtain those records is doing so through the power of the court by way of subpoena.

You need to go to a doctor and tell him/her all your complaints in order to get a medical record. Take the "worm" with you and ask the doctor to identify it and not that in the report. Yes you can sue the company. But you don't have "damages" of much value.? (The value of the injury you suffered isn't much). You have no leverage to get money from the company.? They'll probably send you a coupon.
