The legal analysis is that you have a valid workers compensation claim, and you should be getting temporary disability benefits so that you can take off time from work and medical care paid for by the compensation carrier. Additionally, depending on the nature of your injury, you may have a claim for permanency under the workers compensation statute. Finally, if your employer fires you, you will have whistleblower's claim because your employer cannot fire you for asserting your statutory rights. At the same time, these are claims. Workers compensation benefits are less than what you earn, and while you will have a whistleblower's claim against your employer, you will have to pursue that and litigate it over time, so factor that into your decision making process.

What are my rights if I am the victim of aggravated assault by military personnel?

Personal Injury lawyer at Tuttle & Associates
Proceed with the criminal prosecution first and then you can use the criminal conviction to stop the defendant from arguing that the assault didn't occur. Assaults are not covered by insurance so you will have to collect the damages from the person. if he or she doesn't have assets, that will be a futile process.

Is it lawful for a company to fire my husband after an injury?

David F. Stoddard
Answered by attorney David F. Stoddard (Unclaimed Profile)
Personal Injury lawyer at The David F. Stoddard Law Firm
When you can fire someone after an injury can be complicated. If an employee has worked at a company for more than a year, the Family Medical leave act provides that you get up to 12 weeks leave for a serious illness. A serious illness is an illness that requires you to be out more than 3 days or requires ongoing treatment by a physician. Thus, if you have been there a year, and the injury fits the definition of serious illness, you cannot be fired for being out. You can be fired for violating safety rules or any other reason, but not for being out sick. If you have been there less than a year, they can fire you for being out even if you are under a doctor's care. As for hiring a lawyer, you can. However, your damages in a suit, if you have one, are lost wages, which is what you would have earned had you not been fired minus any earnings at a new job. If he is making the same or more than he made at his old job, he has no damages to sue for.
