In order to win a slip and fall you must prove that the condition had existed for a period of time and that the store had time to become aware of it and clean it up and did not. they apparently are claiming that the incident happened moments before and there was not sufficient time to clean it up. Sounds like you might not have much of a case. they can do whatever they please with their tapes. If you get to court you can subpoena them but to what end. What will that prove?

In California, you can and should commence a worker's compensation claim which will provide you with medical care and temporary disability if your doctor takes you off work. You and your WC insurance carrier would also have a claim against the driver's insurance company. You should contact an attorney near you who handles these types of claims.

If you have an attorney, he or she can make the proper assessment based on the severity of injury, the degree the other side is liable, your age, your recovery time, your missed time from work, if any, damage to your earning capacity, the medical expenses incurred, etc. These are all significant factors, without which no one can answer your question with any detail.
