Should I obtain legal counsel if the dentist failed to provide accepted standard care by not reviewing my medical history?

Actually, the question is more to whether you can find a lawyer who would be willing to take your case. Although you state good grounds for dental malpractice, the fact of the matter is that in order to file a case, you will need an expert witness. That's expensive. Plus, these cases generally do not settle, so there will be a great deal of time and money spent on bringing the case forward. Now the question is, what would be the likely recovery? You felt horrible. No doubt. But, were there any lasting effects? Any permanent disability? Unless there are major damages, doctors and dentists can (and do) get away with malpractice, no matter how obvious.

Do I have a case if the radiologisty misdiagnoised a rupture leaking implants and had surgery for nothing?

Howard Dale Mishkind
Answered by attorney Howard Dale Mishkind (Unclaimed Profile)
Personal Injury lawyer at Mishkind Law Firm, Co., L.P.A.
It has to be established that the interpretation of the MRI was in error. If the misread was a close call or one that prospectively (looking at it at the time of the MRI) was consistent with a rupture, it will be difficult to prevail in a claim against the doctor. If you can obtain the 1st MRI and have it reviewed by an independent radiologist to determine if it was clearly misread then you may have a viable claim against the radiologist. It is possible that the radiologist, depending on the interpretation report generated to the surgeon, might argue that the ultimate decision whether to remove the implant was a decision to be made by the surgeon and thus try to exculpate himself from any liability. You are advised to discuss the specifics of your case with an attorney in your area that has experience in this type of claim I would be happy to talk to you to see if I can answer your questions and determine if there is merit to your claim.

If a person was driving my car drunk and totaled it but was not issued a DUI can I sue the state for not issuing one?

James Peirce Kelaher
Answered by attorney James Peirce Kelaher (Unclaimed Profile)
Personal Injury lawyer at Kelaher Law Offices, P.A.
No. It is within the sole discretion of the investigating officer whether to issue a ticket. If the adjuster is balking at paying the damages because their insured was not issued a ticket, tell the adjuster that he/she is out to lunch because the issuance of a ticket is not admissible in a civil court proceeding anyway.
