It probably won't because it is not a debt that you owe unless and until they win the case. If you have an option of placing the home in h\your husband's name, you may want to consider that in case a judgment is entered against you.

I'm sorry that you and your mother are facing this very difficult situation. You can always file a lawsuit against the uninsured motorist and seek compensation for your mother's injuries, including medical bills, and pain and suffering. However, there's little value in a money judgment if the at fault driver has no insurance and can't afford to pay. Many times, vehicle insurance policies include additional coverage for uninsured motorists (UIM) precisely for this very unfortunate occurrence. Your mother's insurance company, assuming she purchased this additional coverage, should pay for the damages up to the policy limit. Also, it's possible that although the at fault driver doesn't have his or her own insurance, the driver may be covered on someone else's insurance policy, like the owner of the vehicle (assuming they are not one and the same), or their employer (if the driver was working at the time).
