Generally you are entitled to approximately 2/3 of your pay while you are disabled from an on the job injury in Michigan (there is a specific statutory table that "pegs" your rate). You are also entitled to have the work comp insurer/employer pay for all incident related medical care and treatment. If you have Sickness and Accident insurance you may have collected those benefits, but typically work comp offsets such benefits from their payments for indemnity (ie: wage). You may be entitled to a "specific loss of use" calculation as to the # of weeks of wage benefits you receive, which could conceivably extend the benefits beyond the time you are not disabled. I'd recommend a free consultation with a local Michigan lawyer who regularly handles workers compensation cases.

Not enough information here. I doubt it though. ER rooms are normally backed up and it is not uncommon to wait 2 to 12 hrs in an ER also you would have to prove that any delay which was negligent in some way caused you additional damage and injury. Apparently it did not.

Since you didn't sign anything, you can change your mind. Your lawyer is certainly going to have a problem with that, as he has probably told opposing counsel that they have a deal, and you will be hurting his credibility by going back on your word. It could be that the offer is absurdly low, but it could also be that your concept of a fair settlement is unrealistic. It may be worthwhile to pay another lawyer a few hundred dollars to review the file and give an evaluation of the case.
