Generally speaking, a property owner does have the duty to keep his/her property safe. However, merely leaving a ladder on the property doesn't necessarily constitute a dangerous condition for which the owner can be sued if someone uses it without permission. The ladder has to constitute a dangerous condition and other circumstances have to be present to make the owner liable.

Although you list "Nebraska" as the State I do not believe Nebraska law would govern your question. The reason I state this is that I am not aware that any cruise ships are headquartered in Nebraska and the way your question is worded I am assuming that the "company" you are referring to is the Cruise ship itself. In addition, for most offers I have seen for things such as you ask about, if you read the fine print, they indicate that the offer is subject to a particular State's law, which is usually where the company's headquarters is located. If my assumption is wrong and a Nebraska company made the offer or that Nebraska law should otherwise apply you should re-ask your question and make sure you mention that the company is subject to jurisdiction in Nebraska. If the offer states what State's law it is governed by, you should re-ask your question and list that State instead of Nebraska. As I do not believe Nebraska law applies, I cannot answer your question as I am only licensed to practice law in two states, neither of which is the home of any cruise ship company. If you assume that Nebraska law does apply then whether presenting "10,000 chocolate bar wrappers" constitute "good consideration" would depend on the specific language of the offer. For example, if 10,000 chocolate bar wrappers were presented but the offer for the cruise says it has to 10,000 lollipop wrappers then the company could deny accepting the wrappers. I cannot provide you a case that states this but it could probably be found.
