He can't really sue the homeowner or the homeowner's insurance. Normally with an insurance, you sue the insured, which in this case is the homeowner, and insurance pays the claim if you can establish that the insured is liable. In this case, the homeowner would have to have been negligent by act or omission to be liable for this injury, and nothing in this story suggests to me that the homeowner is in any way liable. It is possible that the homeowner's insurance has a "Med Pay" provision that will pay medical bills up to a certain amount, usually $5,000.00, for any injury that occurs on the premises, regardless of who is at fault.

If your lawyer will not return your phone calls, let you know how the case is proceeding, discuss the pros and cons of the case, discuss how cases are valued and what his/her thought of the value of your specific case, etc. then it is likely time to get a new lawyer. You may hire/fire lawyers as you wish. You may have some obligation to pay any costs and/or there may be a fee claim, but any new lawyer can usually work those out for you by giving the old lawyer a lien on any recovery.
