Yeah, it's common, but no guarantee. It would help if witnesses get all equivocal such as "I didn't see anything" "I don't know who threw the first punch" "There were fists flying everywhere," might get it plead down to disorderly conduct.

He may, but what are the damages? Obviously time is money, but unless he suffered some medical detriment, it is doubtful any attorney would take the case on contingency. He might make a written demand for compensation for the time he lost waiting and the frustration/emotional distress that ensued over the 21 hour wait.
