If I decide to refuse any offer from the insurance company, do I still owe my attorney any fees?

You should have a copy of the fee agreement with your attorney. That agreement should define your legal obligations to your attorney.

Do I have a case if I fell in a gas station?

Answered by attorney J. Michael End
Personal Injury lawyer at End, Hierseman & Crain LLC
You only have a claim for more than payment of the medical bills if you can prove that the gas station owner was more negligent than you were in causing your fall. The Wisconsin Safe Place Law would apply to your case, but you still must prove that the owner of the station was negligent. If the owner of the station was not negligent or if your negligence in causing your fall was greater than the owner's negligence, you would not recover anything other than what is being offered to you. The owner's medical payments coverage of the insurance policy probably pays medical bills, to a certain limit, regardless of fault.
