This situation arises often. Usually the dismissal is filed after receipt of the settlement draft, but before the settlement draft is negotiated (deposited into your bank account). If the defense atty will not send the check until you sign the Request for Dismissal (RFD), make sure to send a cover letter with the RFD stating that (1) the RFD has been signed in reliance on your receipt of the settlement draft; and (2) the defense attorney is not authorized to file the RFD until you have confirmed receipt of the settlement check with him/her.
