Perhaps. You didn't have the cracked rib before. It must have been a pretty big crash. As a passenger, you would be insured by the auto policy of the car you were riding in. Did that car have PIP coverage? If not, did you have PIP coverage on your cars? IF the drunk was insured, it was probably a high risk insurance limit. The drunk's insurer will want to talk settlement. IF the drunk was not insured, again, you would be insured under the policy on the car you were riding in, so hopefully that car has UIM coverage. If not, you can go on the UIM coverage on your own car policy. You should consult with an experienced P.I. lawyer in your area.
