It depends. This question is fact sensitive and can't be answered with the limited information provided. I will provide a general answer based on the following assumptions. The walkway lies on both properties, essentially straddling the property line (the length of the driveway). There is no written or verbal agreement between the property owners concerning the use of the driveway (including in their respective deeds, CCRs, HOA, etc..). It's possible that the property owners (or their predecessors in interest) acquired the right to use the walkway through a prescriptive easement (this may have occurred decades ago). A prescriptive easement results by operation of law (not by written agreement) when one party uses another's land "open and notoriously," "uninterrupted (doesn't not have to be every second or even every day)," "under claim of right (property owner believed he could use it, regardless of what adjacent property owner thought)," "hostile" (without permission), for a period of at least 5 years. When such use has continued for a particularly long time, the courts presume the use is without permission, requiring the opposing party to come forward with affirmative proof to rebut the presumption (e.g., letter stating the use is permissive). Thus, it's possible, that each property owner acquired a prescriptive easement to use the walkway (or rather that portion that lies on the adjacent property) for the limited purpose of accessing their vehicle (and perhaps other uses like maintaining the walkway). It's also possible, but not likely, that one of the property owners may have acquired the entire walkway through adverse possession. This would require that one of the property owners paid property taxes on the entire walkway (along with the other elements referenced above for a prescriptive easement). This could happen if the county tax assessor visited the subject properties and mistakenly concluded that the walkway was part of only one of the residences, and increased the taxable square footage accordingly (and the property owner paid the assessments).

Contact the company tell them what happened, follow up, follow up, follow up, become more of a pain in their neck than is worth it to them, they will try to stonewall you. Finally, when they've had enough tell them you want $3,500 and when they offer you $1,000 take it.
