First, you need to realize that your partner is a violent abuser who is going to continue to pummel and hurt you until (1) you get him out of your life forever or (2) he makes good on his threat to kill you. This isn't legal advice, it's human advice: Tell this guy it's over and you never want to see or hear from him again, then move somewhere else and never speak to him again. Never. And stick to your word. You may care for him, and he may say he cares for you, but actions speak louder than words. Get rid of this guy before he kills you. You can also get a restraining order against him. Check with the nearest Superior Court for that, or visit a local attorney to help you. Second, you can and should report him to the police for battering you and threatening your life. Hopefully he will be arrested, making it easier for you to get out of there permanently. Tell the police the full story, and if they ask if you want to press charges, you do. Jail might not tame this fellow, but it's the best thing the government can do for you at this moment. Third, and maybe this should be first, go get medicall attention immediately. You may have had a concussion or other serious head injury, and you need to be sure you will be all right as soon as possible. Fourth, you have the right to sue this person for personal injury, and you should visit a personal injury attorney soon. Good luck to you.

Maybe, but it's a bit of a stretch: this was just horsing around and the other child didn't mean to injure yours, it's just that when you are five years old, you don't have the judgment to evaluate the probable outcomes of your actions. That being the case, this was the unintended result of an intentional act, which is negligence, which is covered by hormeowner's insurance, even off of the homeowner's property. Ask the other mother about homeowner's insurance and put in a claim, you have nothing to lose.
