The restaurant's insurer should reimburse your medical expenses, up to the limit of liability purchased, under their "med pay" coverage (usually this has a limit of a few thousand dollars). This reimbursement should not require a Release to be signed, nor have anything to do with who was negligent. Talk to them about that. Under the liability limit (which should be substantially greater than the med pay limit) the insurer for the restaurant should pay for any medical expenses not already reimbursed under med pay, as well as pain and suffering and any other out of pocket losses in a lump sum as part of any settlement. A Release would likely be required and you would settle all past, present and future claims. You, or a lawyer you hire, would negotiate the amount with the insurer. They would investigate the liability and the damages. You would supply medical bills, wage loss verification, information on how bad your injuries were, whether they require ongoing care, etc. There is no set time to resolve such a case. Usually insurers drag their feet and hold on to the money as long as they can. The only way to force any timeline on things is to start suit and then a Michigan court will set the dates for things to be done. Usually you'll have a Trial Date assigned that will be around 1 year out from the filing date. Of course, starting suit will require costs to be expended to do discovery, prove the negligence of the restaurant, prove your damages, etc. They typical Michigan attorney fee for a premises liability claim is 33.3% of the net recovery.

You can only bring a claim for medical malpractice if you can get a "similar health care provider" (another doc of the same specialty) to give you an affidavit saying that (1) there exist reasonable grounds to support a claim for medical negligence, and then later (2) that the doc deviated from and fell below the prevailing standard of care. Go hire a personal injury attorney skilled in handling medical malpractice cases as there are too many hurdles for you to navigate; as a matter of fact, most personal injury attorneys don't know how to handle medical malpractice cases.
