What is the law of limitations on personal injury when the victim never filed a charge because he had no insurance?

default-avatar
Answered by attorney Matthew Corey Frisby (Unclaimed Profile)
Personal Injury lawyer at Frisby Law Firm
In Oklahoma there is a two year statute of limitations on personal injury actions arising out of a motor vehicle collision. A statute of limitations is a law which places a time limit on pursuing a legal remedy in relation to wrongful conduct. After the expiration of the statutory period, unless a legal exception applies, the injured person loses the right to file a lawsuit seeking money damages or other relief. The statute of limitations specific to your situation needs to be reviewed by a qualified attorney. The information here has been prepared for informational purposes only and should not be construed as legal advice or a legal opinion on any specific facts or circumstances. Do I have a case if I got served a raw burger at a fast food restaurant?

Gregory Casale
Answered by attorney Gregory Casale (Unclaimed Profile)
Personal Injury lawyer at Gregory Casale, Attorney at Law
Only if you suffered actual harm as the result and you can prove that you both received the raw burger AND that it was the only cause of your harm (illness). Not a strong case I am afraid.

What are contingent based attorney fees and costs for a medical malpractice case?

default-avatar
Answered by attorney Michael Alexander Yurasov-Lichtenberg (Unclaimed Profile)
Personal Injury lawyer at Havens Lichtenberg PLLC
In New York, an attorney litigating a claim for medical malpractice on a contingent fee usually can take 30% of the first $250000 of the judgment or settlement and, on a sliding scale, down to 10% of the amounts over $1.25 M If the amount of work that had to be done to win the case was disproportionally large, the court can increase the attorney's fee. Litigation costs are usually "fronted" by the law firm and recouped from the judgment or settlement.
