Any remedy you have is covered by Workers' Compensation, assuming you are an employee and your employer has paid for workers' compensation as is required by law. If you are indeed covered by Workers' Compensation, you cannot file a lawsuit in court.

What you are going through is a subrogation claim brought by the insurer of the opposite party for the amount of the damages for repairs to that person's auto. This is similar to a collection claim and the people you have been dealing with are essentially bill collectors. The next step is for the insurer to file suit against you, probably using the name of its insured as plaintiff. If you lose that suit several unpleasant things will happen. The insurer will place a lien on your real estate. You won't be able to sell it without the lien being satisfied. Undoubtedly the insurer will also go through post judgment discovery at that point and find out where your bank accounts are and will garnish them, along with your wages.? They will also seize any assets of yours they can get their hands on, using law enforcement to do so. Also, the law allows the insurer to report to the authorities that it has an uncollected judgment arising out of an auto collision for which you have no liability insurance. Georgia is a mandatory insurance state. The State of Georgia can (and probably will) suspend your driver's license and take the tags off your car until the debt is paid. Do not mess around with this. Hire an attorney ASAP. This is serious stuff with potentially bad consequences for you. The only good news is that it sounds like a defensible case if handled right. If you don't know whom to hire contact me and I will refer you at no charge.
