If you can prove that the hard object was not part of the food and that is what caused the tooth to break you can bring a claim for the injury. I hope you saved the object, reported it to the restaurant at the time of the event and have a dental bill to show what the cost of the dental treatment has been or will be. You may be able to resolve a claim of this nature directly with the restaurant or the insurance company for the restaurant.

None of this makes sense. Talk to a doctor about the problem, infection is a funny thing. It is everywhere and no one knows where it comes from in every case. You seem to have hurt feelings more than anything else. You will get nothing for hurt feelings.

You can sue them, get a judgment, but probably never recover. Deadbeats are deadbeats. If they were charged with assault, you might qualify for the Montana Crime Victims Compensation Act for your medical expenses that are unpaid. There is no "lumbar replacement" surgery. Find a new doctor.
