Other than that, there is the Motor Vehicle Accident Indemnification Corporation, if there is a personal injury involved. Finally, you might be able to get a judgment against this person, which will haunt him for the next 10 years. There are enforcement procedures in place for that as well.

You can sue the other driver for your injuries (medical expenses, pain & suffering etc.). If you settled for the property damage on your car with your own carrier, I do not believe you can go to the other drivers carrier to get more money. In fact, your carrier will subrogate the claim against the other drivers carrier. This means they will make a claim to get reimbursed from the other driver. If they get money, you will get your deductible, but thats it.

State Farm can do anything they want, unless there is an Order from a court otherwise. They especially attempt to do unpredictable things when there is not an attorney involved. If you are hurt, it is to your advantage to at least talk to an attorney specializing in this area of law, before accepting a settlement offer.
