Can child support affect an immigrant for residency?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
You will have to show the ability to support him but the fact that you are not able to support yourself and any children without his income is also good evidence for a waiver case if he qualifies through his marriage to you.

Can I apply for citizenship even though I am separated from my husband?

Answered by attorney Francis John Cowhig (Unclaimed Profile)
Immigration lawyer at Francis John Cowhig
Not after 5 years of residency. However, if you received your green card through marriage to your U.S. Citizen husband and tried to become a citizen after 3 years, your separation could cause a problem. However, if you wait for 5 years before applying for citizenship, your separation or, even divorce, should not be a problem.
