Do I have to leave the US to file the I-130 petition if I overstayed my visa?

You should not leave the country. You are eligible to file for adjustment of status even if you overstayed your student status. The 10 year ban only comes into the picture when you depart the US. So as long as you don't leave the country, you can apply for your green card and stay. The entire process only takes about 3 months from start to finish. And there is no penalty when you overstay your visa as long as you are married to a US citizen : ).

It will take 1-2 years for the approval. However, they are currently processing for an immigration visa beneficiaries whose visa petition was filed on or before April 22, 1990. As such, your brother and his family would be waiting a long time, perhaps 24 years or more, until he and his family could immigrate to the United States. Any children included in the petition would likely turn 21 and age out of the petition.

Technically you can use a co-sponsor in addition to you acting as a primary sponsor. In fact, one of our clients recently used a co-sponsor for his fianc? in Peru. Having said that, I have seen reports that some embassies do not accept affidavits from co-sponsors. You may be able to use your assets in the event that your income isn't sufficient to meet the USCIS thresholds. I would advise you to contact an immigration attorney if you are concerned about the sufficiency your income.
