There are many factors to consider when determining whether to file a new petition.  For the EB-2 category, in addition to you having either an advanced degree or a bachelor's degree plus 5 years of experience, the position must also require an advanced degree as a minimum qualification for the position.   For September 2011, the priority dates for all countries are current in the EB-2 category, except for India and China.  The cut-off date for India and China is April 15, 2007.  Assuming that your I-140 has been approved, you would be able to retain your EB-3 priority date of September 2008.  If your home country is India or China, your priority date would not be current yet. You have raised some very good questions and I urge you to contact an experienced immigration attorney to review your options.   Best wishes, Mark

Yes. Immediately file the I-130 and make sure it is well prepared and fully documented. Once you have the receipt notice prepare an application for the ICE TA regarding exercising prosecutorial discretion under the "Morton" memo. With that your attorney would ask the TA to make a joint motion for the IJ to administratively close the case to allow your husband to apply for the adjustment of status as the ground of relief from deportation. Remember, the Immigration court has jurisdiction over your husband, but you can file your I-130 with the USCIS. Hire an excellent, experienced attorney

Hello, if your grandfather has been outside the United States for that long, a five year time period, then he will have to begin the process all over again. In order to do that he has to have a qualifying sponsor, which in his case would be a son or daughter who is a United States citizen. There is no grandson category for him to qualify under.
