The real question which needs to be answered is ?Are they now legitimately and legally married? The fact that they waited beyond the 90 day period to marry, should not be a problem, although questions may arise as to why they waited so long. Either way, your brother did not break any laws and as long as he married his K-1 fiance, she will not be deported. However, your brother's secrecy and behavior as stated in your scenario, does raise questions and concerns regarding whether or not they did, in fact, get married. If they did not get married, he still does not have anything to worry about and did not break any laws. His fiance on the other hand is subject to removal/deportation and may have been barred from reentering the U.S. do to overstay her visa. I hope this information helps.

Generally an application for a U.S. citizen baby to receive needs-tested public benefits will not impair a foreign national parent's eligibility to succeed with a Petition to Remove Conditions (to replace Conditional Resident status with full Permanent Resident status). It would be wise for you to consult with an immigration attorney regarding the specific details, and to provide legal representation in the petitioning processes.
