I just migrated here in January 2011, how soon can I marry my fiancee?

Answered by attorney Eric M. Mark
Immigration lawyer at The Law Office of Eric M. Mark
If you are a green card holder you can petition immediately after marrying, but a visa will not be available for several years. Consult with an attorney for better information. I offer free phone consultations.

Should I still hope for a good outcome ?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
You should probably wait out the process if you wish a life in America. Although there is no guarantee that the waiver will be approved, being married to a US citizen for eight years usually provides grounds to satisfy the hardship requirement of an I-601 application. Having a good lawyer to assist in preparing the application also usually helps. I am a US Citizen and I submitted an I-130 for my spouse overseas. We now have a newborn. Do I file a seperate I-130 for our child?

Answered by attorney Stephen Arnold Black
Immigration lawyer at The Law Office of Stephen A. Black
In most cases, the newborn may already be a US Citizen. File a CRBA (Consulate Record of Birth Abroad) at the US Consulate.
