What are the rights of a conditional permanent resident being abused by a US citizen?

Answered by attorney Phong Thanh Tran (Unclaimed Profile)
Immigration lawyer at Law Office of Pho Ethan Tran, PLLC
If you are being physically abused, the very first priority is your safety. You need to call the police and/or find a safer place to stay. As for your immigration status, you can still petition to remove the conditions on your residency even if you are no longer with your husband as long as you have sufficient evidence to establish that you were married in good faith or that you were abused by your spouse during the marriage.

Can younger brother give his older brother the US citizenship?

Answered by attorney Francis John Cowhig (Unclaimed Profile)
Immigration lawyer at Francis John Cowhig
Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated The first question that would need to be answered is how did the 15 year old acquire U.S. citizenship? In order for a U.S. citizen to petition someone for a green card, the U.S. citizen must be 21 years of age. I strongly suggest that you contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding your son's situation. He/she would then be in a better position to analyze his case and advise you of your options.
