Your email is unclear as to what is your immigration status. If you are a US permanent resident, you do not need to apply for anything. If not, and if your 21 old son is a US citizen, I would suggest for him to apply for green card for you.

It depends on the type of charge. Something like possession of a gun or domestic violence (for example) could render you deportable. A conviction such as driving with no driver license would probably not hurt you very much. Another issue: It also depends on whether this is your first ever crime or whether there was some others before.

You can likely file the I-485 application during the time that you are on probation for DUI.
