Your soon-to-be husband will be able to sponsor them as step-children. They can either Consular Process or if they have visas to the U.S., there may be options to adjust status. Either way, you need to schedule a consultation with an attorney to discuss the matters in detail.

Will it effect receiving my green card if I'm illegal and my husband former inmate?

Julia Ridgway Binger
Answered by attorney Julia Ridgway Binger (Unclaimed Profile)
Immigration lawyer at Law Office of Julia R. Binger
By itself, your husband's criminal history should not prevent you from getting a green card.  Similarly, if your husband is a US citizen then the fact that you became illegal by overstaying does not by itself prevent you from getting the green card.  There are a number of other reasons why someone might be denied permanent residence, but these two factors should not raise a barrier for you.
