How do you get back your papers if it has been expired 8 years ago?

Sorry, but you did not give enough information for a comprehensive response. If one of you is a U.S. citizen (or has a green card), and another is an alien who entered the U.S. legally but lost status in 2005, then the immigration law provides for a solution to your problem. It is called adjustment of status and gives the beneficiary a green card. If the situation is different, then you might want to re-state your question.

How do I go about marrying an Australian woman with the visa waiver program and temporarily staying in the U.S.?

You can marry her while she is here on the visa waiver and she can stay. Once married, she can apply for a green card. The entire process takes only 3 months from start to finish if done right. She will be eligible to receive a work/travel permit as well (while she is waiting for the green card). There will be an interview at the local immigration office to make sure that you guys are the real deal. Please consult with an experienced immigration lawyer before finalizing your wedding plans. The timing of the wedding can be an issue as well.

Can anyone suggest me what to do I need to go back home since my parents are sick I did not see them from last 5 years?

Answered by attorney Kevin L. Dixler
Immigration lawyer at Law Office of Kevin L. Dixler
You may have to mandamus to get an order forcing the U. S.C.I.S. to make a decision. This can take time. You may be barred for ten years if you leave the U.S. You may also lose your right to adjust status, as well. It is unclear whether you qualify for advanced parole. Also, its unclear how much time that you can delay travel. I strongly recommend an appointment with a competent and experienced immigration attorney. Good luck.
