Hello , I have a question about the F3 immigrations

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
It would be wonderful if the F-3 immigration category for married sons and daughters of US citizens would only take a year and a half. There is unfortunately no truth in the rumor. The category will continue to take approximately 8-10 years to complete an immigration case.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. What can I do to make my husband a legal immigrant of the United States?

Christine Victoria Troy
Answered by attorney Christine Victoria Troy (Unclaimed Profile)
Immigration lawyer at The Law Office of Christine Troy
I recommend you have a consult with a competent immigration attorney in your area. A few things to look at: did anyone ever file any immigration papers for him before April 30, 2011? Has he ever been the victim of a crime in the US where he helped the police? How did he enter the US? Has he ever been arrested or convicted? These will be important factors in whether he can apply for a GC in the US or needs to leave the US in order to file. In the latter instance, he will need an extreme hardship waiver so you also want to have the attorney analyze that for you, because the departure triggers a ten year bar to reentering the US if the waiver is not approved.

If I am filing a political asylum, how can my wife maintain a legal status?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
It is always best for both of you maintain nonimmigrant status if you can. If you can't then she will have the same rights as you under the pending asylee application.
