Can I go for H1B visa stamping & H4b visa stamping for my wife at the US embassy or that is invalid because I re-entered The US using advance parole?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Reentering the U. S. on an advance parole instead of H-1B is not a permanent choice. The individual holding an H-1B status can simply go outside the United States and come back in using the H-1B visa instead of advance parole the next time. And so you can go overseas and have H-1B and H-4 stamping for yourself and your wife before your I-485 is approved. How can I start the process for to get my mother papers?

Answered by attorney David H Nachman
Immigration lawyer at NPZ Law Group
This process is generally done by way of a filing of the petition for an alien relative along with an application for an adjustment of status if your mother is in status in the US. If she is out of status there may be other ways to do it. It may be that she requires a waiver. The filing of the waiver is a separate analysis that needs to be undertaken as part and parcel of this process. The complete analysis should be undertaken before papers are filed on her behalf. If you would like to have the assistance of a qualified immigration lawyer, please feel free to contact us or to look online for someone would be able to assist you. If you decide to engage an immigration lawyer you may want to be certain that he or she has a specialization in the field.

Answered by attorney Isaul Verdin (Unclaimed Profile)
Immigration lawyer at Verdin Law
You can go ahead and apply for his green card. He doesn't have to leave because he entered with inspection. Great case. Best of luck.
