What happens if the illiegal immigrant doesnt get approved for the provisional waiver

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
In most cases where an I-601A provisional waiver is denied, U.S.C.I.S. will take no further actions against the individuals and they will be in the same position as they were before making the application. If an I-601A is approved, the applicants will generally stay in their home countries 1 to 2 months (in our experience). What form of affidavit do I need if my I-130 has been approved?

Answered by attorney David H Nachman
Immigration lawyer at NPZ Law Group
You will first have to file a Petition for an Immigrant family member on Form I-130. You should let the National Visa Center know that you want to process the green card at the U.S. Consulate abroad. Please note that the process for sponsoring a member of the family has many nuances and we encourage you to consider hiring a qualified immigration lawyer or attorney with regard to this matter. One particular nuance has to do with the planning or filing of the Affidavit of Support Form and package.

I am a green card holder in the United States and I was trying to bring my husband from Haiti, how long does it take?

Immigration lawyer at Coane & Associates, PLLC
It takes a long time, at least 1-2 years, if not longer. You might want to explore faster ways for him to come, other than by your sponsorship.
