This process is generally done by way of a filing of the petition for an alien relative along with an application for an adjustment of status if your mother is in status in the US. If she is out of status there may be other ways to do it. It may be that she requires a waiver. The filing of the waiver is a separate analysis that needs to be undertaken as part and parcel of this process. The complete analysis should be undertaken before papers are filed on her behalf. You should be able to travel in and out of the U. S. on your green card as the offense of shoplifting would not appear to be one in which you could have been sentenced over one year or in which you served jail time for over 6 months. You can check the statute under which you were charged to determine the top amount of time that you could have received for the shoplifting offense. The I-751 application to remove the conditional basis of residence status looks to see whether the relationship was bona fide at its inception as seen through the prism of the two-year period of conditional residence. As your wife already signed the petition and you submitted it with your evidence, you will at the stage wait for further action on the part of U.S.C.I.S. It may approve the petition without more. If it requires an interview, you should of course attempt to locate your wife and have her accompany you to the interview. If not, you should attend the interview anyway and explain your situation to the U.S.C.I S. examiner.
