Your wife can file for you now. She doesn't have to be 21. (American sons and daughters filing for their parents must be 21. American citizen brothers or sisters must also be 21 to file for another brother or sister, but there is no such requirement for an American spouse.). She has to be 18 for the affidavit of support, and so she OK to file for you. Good luck.

H1 extension with DUI conviction

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
The DUI conviction should not have an effect upon your continuing eligibility for H-1B renewal. It is not considered a crime involving moral turpitude. If you are applying for a H-1B visa renewal at a consulate or embassy, however, you will have to bring an original or certified copy of the conviction record and notate the DUI on the DS – 160 visa application. A consular officer would generally not be concerned with a single DUI although more than one might raise questions as to whether you are inadmissible for chronic alcoholism.
