His criminal defense attorney should consult with an immigration attorney when resolving his case. Then I could advise you about his immigration case.

How long does it take total to get a K-1 Visa for a German Citizen, and can he stay in the US after the K-1 visa as long as we apply for a greencard?

Answered by attorney Stephen Arnold Black
Immigration lawyer at The Law Office of Stephen A. Black
Yes you can sponsor your fiancé for his fiancé visa. Retain counsel to pursue the case from start to finish. Counsel anywhere in the USA can represent you. Some of us charge very affordable flat fees to represent you. Call to discuss.

Can I still apply for asylum after 5 years?

Answered by attorney Michael Alexander Yurasov-Lichtenberg (Unclaimed Profile)
Immigration lawyer at Havens Lichtenberg PLLC
You had to apply for asylum within 1 year from the arrival to the U.S. Now, you might only get withholding of removal which is different from asylum in that it does not lead to a green card and citizenship; you will be able to stay in the U.S. but have to renew work authorization every year or two and travel abroad only on an advance parole. If you marry a U.S. citizen, you can get a green card through a family petition: because you entered the U.S. legally, on a visa, your illegal overstay will be forgiven.
