How long it currently take for her to get a visa if I’m a US citizen and I want to bring my wife from Afghanistan?

Answered by attorney Bruce A. Coane (Unclaimed Profile)
Immigration lawyer at Coane & Associates, PLLC
That typically takes a long time because people from Afghanistan require very lengthy background checks. For women it is typically less time, but can take 1-3 years or longer.

Will I be able to marry my non-resident same sex partner in California?

Answered by attorney Louis M. Piscopo
Immigration lawyer at Law Offices of Louis M. Piscopo, APLC
The federal Defense of Marriage Act (DOMA) prohibits the USCIS from recognizing same sex marriages for immigration purposes. Therefore, even if legally married by the State or even in a foreign country, you cannot petition your now spouse for an U.S.

Can I stay with my to be husband outside the US as long as my re-entry permit lasts?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
It is possible but will delay your eligibility to become a U.S. citizen. I recommend you get his I-130 on file ASAP if you haven't already. You also need to keep in mind the dangers of abandoning your own permanent residency even with a Reentry Permit so be sure to pay taxes every year in the U.S., maintain a residence, bank account and other proof that you will return as it is a factual decision by the Port of Entry Officer or consular officer when your spouse is able to come to the U.S. whether you still intend to make the U.S. your home.
