You cannot apply for H4 until your husband applies for H1. Your husband cannot apply for H1 until April 1, 2014. If you fall out of status, you will not be able to change status. So, clearly, the only option at this time is to apply for a change of status to F2 (or to get another F1, or any other visa your credentials make you eligible to receive).

Hello, Yes, you must legally get divorced prior to any new marriage. You can retain a family attorney in the U.S. where you lived and they can get a divorce based on publications and attempts to locate her.
