Do I need to apply for a visa?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
An individual coming to the United States for purposes of visiting with visa (or for Canadians without visas) must still prove to Customs and Border inspectors that he or she is only visiting the US and not attempting to make the US the country of residence. Visiting the US shortly after leaving may raise questions concerning your intent. Six months is a guide and not a hard and fast rule, but visitors are encouraged to only be in the US six months and less during a year. I 485 for Dependent - can I apply AOS for myself and counselor processing for my family.

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
The choice of whether to apply for yourself or to wait for your wife to come back in order to make the application for adjustment of status is up to you. You are probably aware by this time that the Department of State has changed the October filing date for EB-2 India from 7/1/11 to 7/1/09, making your date unavailable if you are filing under that category. Assuming that your priority date clears before your wife is set to return, you can wait or apply for the green card for yourself and apply for your wife later when she is back in the States. If you take the latter course, you will know ahead of time when U.S.C.I.S. can approve your case at the earliest through looking at the “final action” visa chart for each month that your case is pending adjustment of status. My grandfathers green card status is questionable. He has been outside the US for more than 5 years. I want to get him his papers back. How do I do it

Answered by attorney Stephen Arnold Black
Immigration lawyer at The Law Office of Stephen A. Black
Hello, if your grandfather has been outside the United States for that long, a five year time period, then he will have to begin the process all over again. In order to do that he has to have a qualifying sponsor, which in his case would be a son or daughter who is a United States citizen. There is no grandson category for him to qualify under.
