You are allowed to file an I-130 for him. Most convictions will allow you to also file an extreme hardship waiver to "excuse" the CMT. However some convictions are not waivable. I highly recommend that you seek strong and competent immigration counsel for his case.

If you have a visa which is valid until June 2014, you are allowed to enter the US during the period of its validity. I do note that you will be inspected by Customs and Border Protection and you will have to show that your intention to come to the US is consistent with the visa. For example, if you have a visitor's visa and have been in the US for most of the past year, there might be concern that you are abusing the visa and that instead of visiting here, you are actually visiting the Ukraine.
