Credit card fraud is an offense that not only makes you ineligible for citizenship but also makes you subject to deportation. Filing an N-400 application was a mistake. Now, you need an attorney who practices in criminal defense AND immigration law. It is in your interests to find an attorney as soon as possible because it will be harder to do if you will be taken into custody. Meanwhile, don't let anyone convince you that it is "in your best interests" to take a voluntary departure from the U.S.: your case might be successfully defended, don't give it up - at least, not until to talk to a specialist.

If you are in removal proceedings before an immigration judge, the I-864 is not filed concurrently with the I-130. The affidavit of support is not required until the I-130 has been approved. It is filed directly with the immigration judge when you apply for adjustment of status.

About 10-11 years. Congress allocates 23,400 immigrant visas a year in the F3 category (married sons and daughters of U.S. citizens). For years, the number of petitions far exceeds the number of available visas; hence the backlog. In October 2012, immigrant visas will be issued to the benficiaries of the petitions that were filed in May 2002.
