Since the U.S. Supreme Court's Obergefell v. Hodges decision earlier this year, the same processes, rules and laws for opposite-sex marriages apply to same-sex marriages. This relates both to the process of becoming married and also to immigration-related applications. Regarding immigration-related applications, however, there are some special considerations that may be relevant, such as same-sex spouses sometimes having fewer or different documentary evidence to prove the bona fide nature of their relationship, and immigration attorneys experience in representing people in same-sex marriages can be particularly helpful in addressing those issues.

Hello. You can file for all of their Permanent Residencies (green cards). Your parents can process the fastest in about a year. Your 3 siblings will take about 12 years. When your parents get their green cards, they can file for their children and perhaps cut the wait time in half.  All cases are first processed in the US and then go tot he US Embassy for the interviews and approvals. Let me know if I can be of any help.

Although not entirely clear from your question, I presume that you are a U.S. citizen who is now facing drug trafficking arrest/charges, and who seeks to petition for a fiance to enter the U.S. for the purpose of getting married within the required time, and then proceeding with a marriage-based adjustment of status application process so that the spouse can become a Lawful Permanent Resident (can get a "Green Card"). Note that if one has been arrested for a criminal offense, there is no immigration-related distinction between that and being "charged." Generally, a U.S. citizen's arrest or charge for a criminal offense will not interfere with eligibility to go forward with immigration applications for a foreign national fiance? or spouse. Exceptions may exist where the U.S. citizen is imprisoned and unable to actually live together with a spouse, or is unable to document sufficient income (in the latter case, the problem usually can be solved by having a "joint sponsor"). It would be wise for you and your fiance? to consult with an immigration attorney (and if you have not already engaged a criminal defense attorney, you should do so without delay).
